The Aberdeen Law Project is pleased to report that a member of our representation team successfully secured 1.5 times the value of a tenant’s deposit after a local landlord failed to protect the deposit in a scheme.
Ruth Dale, a second-year law student, fought and won the client’s case in the First-tier Tribunal before going on to defeat the landlord’s appeal against the initial ruling in the Upper Tribunal.
Ruth successfully argued on both occasions that the client’s deposit should have been protected in a scheme and that the tribunal should make an award of 1.5 times the deposit’s value – a three-figure sum – in favour of the client.
On the result, Ruth said: “This was an interesting and exciting case from start to finish – the landlord had clearly breached the regulations in place to safeguard tenants. I was happy with the outcome, as was the tenant. I joined the Aberdeen Law Project and the representation team because I want to help people, I can’t think of a better way to help my community than through pro bono work.”
